1. Introduction

Welcome to App Marketplace. These Terms of Service ("Terms") govern your access to and use of the App Marketplace platform, including our website, services, and applications (collectively, the "Services"). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Services.

App Marketplace provides a platform that connects users with mobile and web applications for business and everyday use. We help users find verified applications while enabling developers to showcase their products to a wide audience.

2. User Accounts

To access certain features of the Services, you may need to create an account. When you create an account, you must provide accurate and complete information. You are solely responsible for the activity that occurs on your account, and you must keep your account password secure.

You must notify App Marketplace immediately of any breach of security or unauthorized use of your account. App Marketplace will not be liable for any losses caused by any unauthorized use of your account.

You may never use another user's account without permission. You may not impersonate someone else, create or use an account for anyone other than yourself, provide an email address other than your own, or create multiple accounts.

3. User Content

Our Services allow you to post, link, store, share and otherwise make available certain information, text, graphics, videos, or other material ("Content"). You are responsible for the Content that you post on or through the Service, including its legality, reliability, and appropriateness.

By posting Content on or through the Service, you represent and warrant that: (i) the Content is yours and/or you have the right to use it and the right to grant us the rights and license as provided in these Terms, and (ii) that the posting of your Content on or through the Service does not violate the privacy rights, publicity rights, copyrights, contract rights or any other rights of any person or entity.

We reserve the right to terminate the account of any user who infringes copyrights or other intellectual property rights. If you believe your work has been copied in a way that constitutes copyright infringement, please contact our copyright agent.

4. Developer Terms

If you are a developer using our platform to distribute your applications, you must comply with our Developer Agreement, which is incorporated by reference into these Terms. The Developer Agreement includes additional terms regarding application submissions, content restrictions, intellectual property rights, and revenue sharing.

Developers are responsible for ensuring that their applications comply with all applicable laws and regulations, do not infringe on any third-party rights, and function as described. App Marketplace reserves the right to remove any application from our platform at any time for any reason.

Developers must provide accurate and up-to-date information about their applications, including descriptions, screenshots, privacy policies, and support contact information. Misleading information may result in removal from the platform.

5. Prohibited Activities

You may not access or use the Services for any purpose other than that for which we make the Services available. The Services may not be used in connection with any commercial endeavors except those that are specifically endorsed or approved by us.

As a user of the Services, you agree not to:

• Systematically retrieve data or other content from the Services to create or compile, directly or indirectly, a collection, compilation, database, or directory without written permission from us.
• Trick, defraud, or mislead us and other users, especially in any attempt to learn sensitive account information such as user passwords.
• Circumvent, disable, or otherwise interfere with security-related features of the Services.
• Disparage, tarnish, or otherwise harm, in our opinion, us and/or the Services.
• Use any information obtained from the Services in order to harass, abuse, or harm another person.
• Make improper use of our support services or submit false reports of abuse or misconduct.
• Use the Services in a manner inconsistent with any applicable laws or regulations.
• Engage in any automated use of the system, such as using scripts to send comments or messages.
• Upload or transmit (or attempt to upload or to transmit) viruses, Trojan horses, or other material, that interferes with any party's uninterrupted use and enjoyment of the Services or modifies, impairs, disrupts, alters, or interferes with the use, features, functions, operation, or maintenance of the Services.

6. Intellectual Property

The Services and its original content (excluding Content provided by users), features, and functionality are and will remain the exclusive property of App Marketplace and its licensors. The Services are protected by copyright, trademark, and other laws of both the United States and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of App Marketplace.

All content, including but not limited to text, images, graphics, logos, icons, audio clips, and software, is the property of App Marketplace or its content suppliers and is protected by United States and international copyright laws. The compilation of all content on the Services is the exclusive property of App Marketplace and is protected by United States and international copyright laws.

7. Third-Party Links

The Services may contain links to third-party websites or services that are not owned or controlled by App Marketplace. App Marketplace has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You further acknowledge and agree that App Marketplace shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods, or services available on or through any such websites or services.

We strongly advise you to read the terms and conditions and privacy policies of any third-party websites or services that you visit.

8. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination, your right to use the Services will immediately cease. If you wish to terminate your account, you may simply discontinue using the Services.

All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.

9. Limitation of Liability

In no event shall App Marketplace, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Services; (ii) any conduct or content of any third party on the Services; (iii) any content obtained from the Services; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage.

10. Disclaimer

Your use of the Services is at your sole risk. The Services are provided on an "AS IS" and "AS AVAILABLE" basis. The Services are provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement or course of performance.

App Marketplace, its subsidiaries, affiliates, and its licensors do not warrant that a) the Services will function uninterrupted, secure or available at any particular time or location; b) any errors or defects will be corrected; c) the Services are free of viruses or other harmful components; or d) the results of using the Services will meet your requirements.

11. Governing Law

These Terms shall be governed and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.
